Schools Have a Duty to Protect Students

When schools fail to properly screen employees, ignore warning signs, fail to report abuse, or cover up misconduct, they can be held legally responsible for the harm caused to students. Illinois law allows survivors to seek compensation from both the individual abuser and the institution that failed to protect them.

Illinois Law Protects Survivors

Illinois has expanded the statute of limitations for childhood sexual abuse cases, allowing many survivors to bring claims even if the abuse happened decades ago.

Under current Illinois law, survivors now have 20 years from the date they discover (or should have discovered) that their injury was caused by childhood sexual abuse. The clock does not start until the victim turns 18.

Additionally, starting January 1, 2026, Illinois law will allow survivors to bring claims at any time if their case was not previously time-barred.
